1. Acceptance of Terms
By accessing or using LicensedCheck.com ("LicensedCheck," the "Site," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must immediately cease use of the Site. We reserve the right to modify these Terms at any time. Continued use of the Site following any modifications constitutes acceptance of the revised Terms.
2. Description of Service
LicensedCheck is a privately operated website that aggregates and republishes publicly available professional license information sourced from official government licensing board databases across the United States. LicensedCheck is not a government agency and is not affiliated with, endorsed by, or sponsored by any federal, state, or local government entity or licensing authority. The Site provides this information as a convenience to help consumers verify professional credentials.
3. Public Record Information
All professional license information displayed on this Site is sourced from publicly available government records that are published by state and local licensing authorities pursuant to applicable public records laws and freedom of information statutes. This information is made public by government agencies specifically for the purpose of consumer protection and public access.
Our collection, aggregation, and republication of this publicly available information is protected activity under the First Amendment to the United States Constitution and applicable state constitutions. Courts have consistently upheld the right to collect and republish public government records, including in hiQ Labs, Inc. v. LinkedIn Corp., 938 F.3d 985 (9th Cir. 2019), aff'd on remand, 31 F.4th 1180 (9th Cir. 2022), and the Supreme Court's decision in Van Buren v. United States, 593 U.S. 374 (2021).
4. Disclaimer of Warranties and Accuracy
THE SITE AND ALL INFORMATION, CONTENT, AND SERVICES PROVIDED THROUGH THE SITE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, RELIABILITY, OR NON-INFRINGEMENT.
While we endeavor to keep the information on our Site current and accurate, professional license information is subject to change at any time by the issuing government authority. We do not guarantee that the information displayed on our Site is complete, current, or accurate at the time you access it. License status, disciplinary actions, and other details may have changed since our last update from the relevant government source.
YOU SHOULD ALWAYS VERIFY LICENSE INFORMATION DIRECTLY WITH THE APPLICABLE STATE OR LOCAL LICENSING AUTHORITY BEFORE MAKING ANY HIRING, BUSINESS, OR FINANCIAL DECISIONS. LicensedCheck is intended as a preliminary informational resource only and should not be relied upon as the sole basis for any decision.
5. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LICENSEDCHECK, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
(a) Your use of or inability to use the Site; (b) any information displayed on or obtained through the Site, including any errors, omissions, or inaccuracies in such information; (c) any decision made or action taken by you or any third party in reliance on information obtained from the Site; (d) any unauthorized access to or alteration of your data or transmissions; or (e) any other matter relating to the Site.
This limitation of liability applies regardless of the theory of liability, whether based on contract, tort (including negligence), strict liability, or any other legal theory, and even if LicensedCheck has been advised of the possibility of such damages. In jurisdictions that do not allow the exclusion or limitation of certain damages, our liability shall be limited to the maximum extent permitted by law.
6. Indemnification
You agree to indemnify, defend, and hold harmless LicensedCheck, its owners, officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Site; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any claim that your use of the Site caused damage to a third party.
7. Removal and Modification of Content
LicensedCheck reserves the right, in its sole and absolute discretion, to remove, modify, suppress, or refuse to display any information on the Site for any reason or no reason, at any time, without notice or liability. The exercise or non-exercise of this right in any particular instance shall not constitute a waiver of this right, shall not create any obligation to exercise this right in any other instance, and shall not create any precedent, expectation, or entitlement for any person.
Any removal or modification of information shall not be construed as an acknowledgment or admission that the information was inaccurate, unlawful, or otherwise objectionable, nor shall it create any duty or obligation on the part of LicensedCheck to monitor, review, or modify any other information on the Site.
8. Prohibited Uses
You agree not to use the Site to:

Claimed profile features may be subject to additional terms and subscription fees.
13. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute, claim, or controversy arising out of or relating to these Terms or the Site shall be resolved exclusively in the state or federal courts located in the State of Florida. You irrevocably consent to the personal jurisdiction of such courts and waive any objection to venue in such courts.

The invalidity of any provision shall not affect the validity or enforceability of any other provision of these Terms.
16. Entire Agreement
These Terms, together with the Privacy Policy, constitute the entire agreement between you and LicensedCheck with respect to your use of the Site and supersede all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between you and LicensedCheck with respect to the Site.
